+What is 'medical malpractice'?
A patient who is harmed by unsafe medical practice or procedures may have a claim for medical malpractice.

+Who can be held accountable for medical malpractice?
Any doctor or hospital or other healthcare provider in Montana is subject to Montana law governing malpractice.

+What is the first step in pursuing a claim?
Deciding when an injury resulted from malpractice requires a screening of the facts for unsafe care. We screen cases by interviewing the injured patient and family members; obtaining all medical records; conducting medical research in authoritative textbooks and journals; and consulting with experts in the field. All of these resources are readily available to us.

Not every injury or bad outcome is malpractice. After our screening process we will give you an opinion whether the case is likely to succeed.

+What about the costs involved in pursuing a case?
Doctors and their insurance companies are well-heeled and vigorously defend themselves. The expenses to pursue a case can run as much as $50,000-$100,000. We advance those costs. We also agree with you to take a percentage of any recovery. In the event of no recovery there is no fee owed by you.

+Why is a medical malpractice lawyer needed for medical mistakes?
A personal injury case arising from a car wreck can be competently handled by most personal injury lawyers. Medical malpractice is a field of litigation best left to those lawyers who are experienced in handling such cases.
